Proper planning and preparation is important in all aspects of life, and your estates and family are no exception. Life and death are full of surprises and we strive to anticipate every reasonably prospective event. Lack of planning can lead to painful arguments, higher probate fees and unnecessary income taxes.

Issues of what should happen with your estate, who should attend to your affairs and when they should do so, more than likely will begin before your death. It may be precipitated by the sale of your cottage, a stroke or a serious accident in the family, and no-one knows for sure when many of these events may happen. So preparation is the key.

We offer careful consideration in the design and preparation of family trusts, lifetime transfers of land, wills, powers of attorney, and living wills or health care directives. We are pleased to work in cooperation with income tax specialists and financial advisors.

In the event of death, we provide comprehensive probate services where required, and succession or survivorship services where applicable.

We can also provide consulting and analysis services and proactive legal risk assessments to help owners recognize existing and potential problems and actions that may be taken to remedy or avoid the risks.

» Family Law
More than any area of law, family law requires a balance of knowledge, experience, good judgment, compassion and creative solutions.

Family breakups are very difficult for the parties and their children. Too often families are further devastated by the financially crippling costs of litigation and the damaging effects that litigation causes and the aggravation of the hurt and anger upon the former families and their respective relationships. Too often, well meaning parents fail to appreciate the ways in which they are each contributing to the hurt and injury their children suffer.

We have the skills and experience to be very effective in hard-fought litigation, but because of the consequences seen only too often, we believe that such recourse should be an extreme measure only in desperate situations. We can provide effective mediation services, negotiations for an amicable resolution by way of a professionally crafted, property settlements, separation agreements or consent divorce agreements. We can also prepare prenuptial agreements and communal living agreements.

» Family Break-up
PILOT PROJECT: Our firm offers a unique pilot project that combines multi-professional services in a bilateral, non-adversarial process that is designed to diffuse the anger often associated with marital break-up and achieve a level of cooperation and tolerance that allows the families to arrive at permanent long-term solutions, while minimizing the hurt, especially of the children.

The parents, families, lawyers and specialized family counselors will work together in achieving sufficient understanding and mutual respect, to be able to generate cost-effective solutions acceptable to all parties involved. It is a solution arrived at by the parties, not by counselors, lawyers and judges and in the process, teaches participants how to survive through further changes and adjustments, without destructive legal processes.

» Litigation
Our lawyers have experience in litigation services at Queen’s Bench and Court of Appeal levels, in areas such as breach of contract, personal injury, property damage, wrongful dismissal from employment, debts, contested estates and many other types of court actions.

We also offer experience in administrative board processes such as Manitoba Labour Board, Canada Pension Plan, Manitoba Public Insurance, Residential Tenancies Branch and other non-judicial tribunals and boards. Each board has different processes, expectations and culture and it is important for each applicant to have this knowledge and experience available to them.

We avoid attendance services in Small Claims Court, but we will offer advice, preparation and directions for Small Claims Court and will act on appeals from Small Claims Court to a judge in Court of Queen’s Bench.

» Dispute Resolution
Our philosophy in all matters is to attempt to arrive at a fair and equitable resolution for all of the parties involved without non-productive contested proceedings and litigation.

We offer skilled and effective services in the mediation and arbitration processes, either as a representative and advocate or as a mediator or adjudicator. Our lawyers in the mediation field are skilled communicators and negotiators and recognize dialogue, integrity and goodwill as key ingredients in any mediation process.

As mediators or arbitrators, we recognize the importance of an unbiased and fair process that allows each party a full and equal opportunity to put forward their respective positions. Mediation and arbitration processes can achieve very satisfactory results of a highly professional standard in a manner quicker and less expensive than a court process.

» Immigration
